Rep. Dan Huberty Arrested for DWI After Crashing Into a Minivan on Friday Night

State Rep. Dan Huberty (R-Houston) was arrested Friday night after crashing his corvette into a minivan in Porter, TX, according to the Montgomery County Police Reporter.

Huberty failed to stop at a red light and drove under a minivan injuring three people. The state representative and former chair of the House Public Education committee failed a sobriety test and was detained claiming he was “returning from the session in Austin.”

While there is a privilege clause in the state code protecting legislators from arrest “during the session of the Legislature, and in going to and returning from the same,” Montgomery County District Attorney Brett Ligon chose to arrest Huberty anyway saying that he was in “breach of the peace.”

Huberty said in a Facebook post, “Last night I was driving under the influence of alcohol and involved in a minor automobile accident in Montgomery County.

“Fortunately, no one was seriously injured. I regret my actions and apologize to my constituents and my family. I know I have a problem and this incident serves as wake-up call for me. I am seeking treatment options to begin today.”
